Here they explain how I did not file properly; I didn‘t give them a full 60 days like you have to with any medical provider.
This is where they say I presented no facts, yet I only listed the findings of the Texas State Board of Dental Examiners as fact. My dentist settled with them, but did not have to cover the expenses for correcting their incompetence.
They also state how much they want to limit the judges decision, though I must admit it surprised me as I left it up to the judge to decide a fair amount if he thought any more was fair than what they damaged. I.e. I was wanting expenses I endured correcting the damage they told me they did, and if the judge agreed whatever he thought was fair.
Again, they really just don‘t want the judge to deem an amount more than fair. Again, I limited it to the max allowed in small claims court anyways.
Maybe the judge was gonna think what they did was terrible and that I shouldn‘t still be in pain after two years from not following basic dental standards? I think he would‘ve stuck to the law anyways though.
